III. Recipients of your personal data
As a global group, we conduct certain activities centrally for specific regions or worldwide through affiliated companies (identified by the company name “Robert Half”). You can obtain further information about our group companies using the contact details provided at the beginning of this statement, provided you are authorized to receive this information. In doing so, personal data may be transferred to these group companies to ensure efficient and consistent business operations and to maintain appropriate control over our business activities. In some business areas, there are also matrix structures, which means that supervisors of our employees may be employed by other companies and may therefore have access to personal data to ensure effective management and organization within the Group. In these cases, these Group companies act as our data processors under our instructions regarding the processing of your personal data.
In addition, we engage third-party service providers who act as data processors. These service providers include software providers, cloud providers, marketing agencies, financial service providers, subcontractors, and technical support companies that are necessary for the fulfillment of our business purposes and help us improve the quality of our services and offer innovative solutions.
If these recipients are data processors, we contractually oblige them to comply with data protection regulations, to implement an appropriate level of data security, and permit processing exclusively in accordance with our instructions. We do not permit these recipients to use the data for their own purposes. Upon termination of the business relationship with these recipients, we require them to return or delete the personal data transmitted or, alternatively, to anonymize it so that you can no longer be identified. Some of these recipients are also data controllers independent of Robert Half who are responsible for processing your personal data for their own purposes. For example, the local tax authority acts as a data controller for tax purposes. We may not be able to impose any obligations or restrictions on these data controllers regarding how they process your personal data.
IV. Transfer of your personal data abroad
Generally, your personal data is processed in Switzerland. However, due to the global nature of our business, your personal data may also be transferred abroad. Our customers, service providers, and group companies are based in EU member states, the EEA, the United States, the APAC region, and India. When transferring your personal data to a country without a comparable level of data protection, we contractually oblige these recipients to comply with an adequate level of protection using the so-called Standard Contractual Clauses, with the necessary adaptations required in Switzerland.
V. Data security
Your personal data will be treated confidentially and may be viewed or routinely accessed only by you, your direct supervisor (and higher-level supervisors in your team’s reporting line), employees of the Human Resources and Payroll departments, and, where applicable, other employees entrusted with managing your employment relationship or assignment (employees and independent consultants). If other employees are granted access to your personal data for financial, budgetary, resource planning, forecasting, or other legitimate business purposes, such access is limited to data related to your work (such as your name, position, office location, and direct supervisor). Access to the data is granted exclusively to individuals who have been previously authorized to do so. Authorization is granted only when there is a genuine business need and only to the extent necessary to fulfill the respective task. We use modern, secure storage facilities and technical safeguards to protect your personal data from unauthorized or unlawful processing or disclosure, as well as from accidental loss, accidental destruction, or other damage. If we engage third parties to provide services and it is necessary for those third parties to access your personal data in order to protect their legitimate interests, we ensure that they are granted access to your data only to the extent necessary for the provision of the contracted services. We also ensure that every service provider we engage is contractually obligated to comply with applicable data protection laws, to treat your personal data confidentially, and to implement appropriate safeguards to protect your personal data.
VI. No automated decision-making in individual cases/support from artificial intelligence
RH uses artificial intelligence (“AI”) to search through personal data and match resumes with job openings/positions in the context of recruitment and placement of independent consultants (non-RH employees) and temporary workers (RH employees), to identify suitable job openings/positions. To this end, RH uses a service provided by Textkernel BV, Nieuwendammerkade 26a5, NL-1022 AB Amsterdam (“TK”), a company based in the Netherlands/EU. This AI helps our recruitment consultants conduct the search for and matching proposed candidates with our clients’ open positions more efficiently. The advantage of the AI search function is that it helps our recruitment consultants review more resumes and match personal data more quickly with clients’ job openings, while disregarding irrelevant data. Our recruitment consultants are presented with a list of suggested candidates who are eligible for a client’s open position. However, this does not result in automated decision-making. Our recruitment consultants decide which candidates to shortlist for a specific client position based on their expertise, their knowledge of the job market, their insight into the client’s company and the job requirements, interviews with the candidates, and other relevant criteria. If anything, it is the clients (through their HR managers) who decide which candidates to select for an interview. Our clients’ HR managers (and not our AI tool) make the final decision on which candidate is selected for the position, if a suitable candidate is available, and subsequently handle the candidate’s hiring. You can object to processing by TK AI at any time by contacting [email protected]. In this case, we will no longer use TK AI in connection with your resume. This will have no consequences or impact, particularly on your application or on the search for suitable positions for you, as we will continue to rely on our personal knowledge of you, the client and their business, the position, and the role’s requirements, as well as the market, and will make every decision independently. If you object to the processing of your personal data by our AI tool, our recruitment consultants will continue to offer you job placement services but will use other methods to search for job openings for you. The personal data of applicants who are no longer available for employment, who are no longer actively seeking a position, who have recently started permanent employment, or who have objected to the processing of their personal data by AI will be deleted by our AI service provider. You can find more information about our AI tool here.

Please also note that when you assert your rights, we may, if applicable, invoke legal restrictions, for example, if we have an overriding interest in retaining your personal data or if we need the data to assert and/or defend against legal claims.
